These Terms & Conditions ("Terms") apply to your use of www.aircontrolconcepts.com (the "Site") and to the AIR Staff Alerts text message program (the "SMS Program"), both provided by AIR Control Concepts LLC ("AIR Control Concepts", "we", "us"). By using the Site or joining the SMS Program, you agree to these Terms.
 
1. SMS Program Terms

1.1 Program description
AIR Staff Alerts, from AIR Control Concepts, sends operational text messages to employees of AIR Control Concepts and its operating companies, including Midwest Mechanical Solutions. When a customer who registered for a company event and named you as their representative is checked in at the event, you receive a text with the guest's name and company. The SMS Program is internal and is not used for marketing.
 
1.2 How to opt in
You join the SMS Program only by texting JOIN to (952) 522-9586. After you text JOIN, you receive a confirmation message. Joining is optional and is not a condition of employment.
 
1.3 Message frequency
Messages are sent only during company events, when a guest you invited is checked in. Message frequency varies.
 
1.4 Costs
Message and data rates may apply, depending on your mobile carrier and plan. AIR Control Concepts does not charge for the SMS Program.
 
1.5 Help and opting out
Text HELP to (952) 522-9586 for help, or contact support@aircontrolconcepts.com. You can cancel at any time by texting STOP to (952) 522-9586. After you text STOP you receive one message confirming that you have been unsubscribed, and you will receive no further messages unless you text JOIN again.
 
1.6 Carriers
Mobile carriers are not liable for delayed or undelivered messages.
 
1.7 Eligibility and your obligations
The SMS Program is open only to employees of AIR Control Concepts and its operating companies. You must be the account holder of the mobile number you enroll, or have the account holder's permission. If you change or give up your mobile number, text STOP from that number first or tell support@aircontrolconcepts.com so that messages are not sent to someone else. Do not forward alert messages outside the company: they contain customer names.
 
1.8 Privacy
We use your mobile number only to send SMS Program messages. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. See our Privacy Policy at https://www.aircontrolconcepts.com/privacy-policy.
 
1.9 Changes to the SMS Program
We may change or end the SMS Program at any time. If the program ends, we will stop sending messages.
 
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any part of it, or use it to send unlawful or harmful material.
 
3. Intellectual property
The Site's content, including text, logos and images, belongs to AIR Control Concepts or its licensors and may not be copied or reused without our written permission, except as the law allows.
 
4. Disclaimers
The Site and the SMS Program are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site or any message will be uninterrupted, timely, secure or error free.
 
5. Limitation of liability
To the fullest extent permitted by law, AIR Control Concepts and its operating companies, officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of the Site or the SMS Program, including delayed or undelivered messages.
 
6. Links to other sites
The Site may link to sites we do not control. We are not responsible for their content or practices.
 
7. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows when they last changed. Continued use of the Site or the SMS Program after a change means you accept the updated Terms.
 
8. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law rules.
